Terms of Service
1. Acceptance of Terms
By creating an account, purchasing credits, or using BuildReport at build-report.com ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, you may not use the Service.
2. Description of Service
BuildReport provides property research reports for trade and real estate professionals. Reports combine property details from town assessing records where we can read them, aerial roof measurements, and FEMA flood and USDA soil data. Where a report has no town record value, it shows a regional planning estimate that is clearly labeled as an estimate and is not drawn from records about the specific property. Each value in a report is tied to a line in the report's Sources list.
3. User Accounts
3.1 Account Creation: You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your password.
3.2 Email Verification: New accounts must verify their email address before free credits are granted.
3.3 Account Responsibility: You are responsible for all activities under your account. Notify us immediately of any unauthorized use.
3.4 Age Requirement: You must be at least 18 years old to use this Service.
4. Credits and Payments
4.1 Credit System: Reports are generated using a credit-based system. One (1) credit generates one (1) property report at a cost of $5.00 USD. Credits are also sold in packs (10 credits for $45 and 25 credits for $100) at the prices shown on the site.
4.2 No Refunds: Credits are non-refundable once purchased. Generated reports cannot be refunded even if the information is incomplete or inaccurate.
4.3 Credit Expiration: Credits do not expire but may be revoked if your account is terminated for violation of these Terms.
5. Report Accuracy and Disclaimers
5.1 No Guarantee of Accuracy: Reports combine town records, aerial measurements and government data with labeled regional estimates. We do NOT guarantee the accuracy, completeness, or reliability of any information in the reports.
5.2 Not a Substitute for Inspection: Reports are informational tools only and should NOT replace professional on-site property inspections. Always verify information before making decisions.
5.3 Estimates and Assumptions: Where there is no town record value, reports contain estimates clearly marked as such. These are regional assumptions and require verification.
5.4 Data Sources: Values come from town assessing records (read from the town's or its vendor's public website, as in New Hampshire, Maine, Rhode Island and Vermont, or, for Connecticut and Massachusetts, from the town's public Vision website where we use one and otherwise from the state's public statewide parcel and assessor file: the State of Connecticut's, and MassGIS (Bureau of Geographic Information), Commonwealth of Massachusetts EOTSS), aerial roof measurements from Google, and FEMA and USDA data. All of these may be outdated, incomplete or wrong. We are not responsible for errors in source data. See our Disclaimer for full details.
5.5 Google Maps Content: BuildReport includes Google Maps Platform features and content (Google's Geocoding and Solar APIs). Your use of Google Maps features and content is subject to the then-current versions of the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
5.6 Saved Reports: A saved report keeps the figures and Sources shown in it. The roof plan drawing is not stored; it is drawn again from aerial data when you open the report, and may be missing if that data has changed.
6. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose or in violation of any laws
- Resell, redistribute, or share reports without authorization
- Attempt to reverse engineer, hack, or exploit the Service
- Generate reports for properties you do not have a legitimate business interest in
- Use automated tools to scrape or mass-download reports
- Copy the roof measurements, plans or town record data in reports into another database or product
- Violate anyone's privacy or property rights
7. Intellectual Property
7.1 Ownership: BuildReport and its content, features, and functionality are owned by Surry Village Creations LLC and protected by copyright, trademark, and other intellectual property laws.
7.2 License to Use Reports: You receive a limited, non-exclusive license to use purchased reports for your business purposes only. You may not resell or redistribute reports.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Surry Village Creations LLC and BuildReport CANNOT be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from:
- Use or inability to use the Service
- Inaccurate or incomplete report information
- Reliance on report data for business decisions
- System downtime or technical failures
OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC REPORT IN QUESTION (MAXIMUM $10).
9. Indemnification
You agree to indemnify and hold harmless BuildReport from any claims, damages, losses, or expenses (including attorney fees) arising from your violation of these Terms, your use or misuse of reports, or your violation of any laws or third-party rights.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Service Modifications
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We are not liable for any modifications, suspensions, or discontinuations.
12. Termination
12.1 Termination by You: You may terminate your account at any time. Unused credits will not be refunded.
12.2 Termination by Us: We may terminate or suspend your account immediately if you violate these Terms, without refund of credits.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or prominent notice on the website. Continued use after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict of law provisions.
15. Dispute Resolution
Any disputes shall be resolved through binding arbitration in New Hampshire, except for claims in small claims court.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and BuildReport.
